Agreement to Terms

By downloading, installing, or using CUStats ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

CUStats is provided by luongnv89 ("we", "us", or "our"). These terms apply to both the macOS application and the associated website at custats.info.

License and Use

CUStats is proprietary software. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on devices you own or control
  • Use the App for personal, non-commercial purposes

You may not:

  • Copy, modify, or distribute the App or its source code
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Remove or alter any proprietary notices or labels
  • Use the App for any commercial purpose without prior written consent

All rights not expressly granted herein are reserved by luongnv89.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of data displayed

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Usage data displayed in the App is fetched from third-party services (Claude/Anthropic and OpenAI Codex) and we cannot guarantee its accuracy.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Business interruption
  • Cost of substitute services
  • Any damages arising from your use of the App

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Your Responsibilities

By using CUStats, you agree to:

  • Protect your credentials: Keep your Claude session tokens, Anthropic API keys, and OpenAI Codex credentials secure. Do not share them with others.
  • Comply with third-party terms: Your use of CUStats must comply with Anthropic's and OpenAI's Terms of Service and any applicable usage policies.
  • Use responsibly: Do not use the App in any way that could damage, disable, or impair Claude/Anthropic or OpenAI Codex services.
  • Accept risks: You acknowledge that using third-party tools to monitor usage may carry inherent risks, including potential service interruption.

Third-Party Services

CUStats interacts with third-party services including:

  • Anthropic/Claude: The App fetches usage data from Claude services. Your use is subject to Anthropic's Terms of Service. OpenAI Codex usage is covered separately below.
  • OpenAI Codex: The App fetches usage data from OpenAI Codex services. Your use is subject to OpenAI's Terms of Service.
  • GitHub: The App's source code is hosted on GitHub. Contributions are subject to GitHub's Terms of Service.

We are not responsible for the availability, content, or practices of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

Intellectual Property

The CUStats name, logo, and branding are trademarks of luongnv89. While the source code is open-source, you may not:

  • Use our trademarks in a way that suggests endorsement without permission
  • Create derivative works that could be confused with the official App
  • Remove or alter any copyright notices in the source code

"Claude" and "Anthropic" are trademarks of Anthropic, PBC. CUStats is not affiliated with, endorsed by, or sponsored by Anthropic. "OpenAI" and "Codex" are trademarks of OpenAI. CUStats is not affiliated with, endorsed by, or sponsored by OpenAI.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the App after changes constitutes acceptance of the new terms.

We encourage you to review these terms periodically. The "Last updated" date at the top indicates when these terms were last revised.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms or your use of the App shall be resolved through good-faith negotiation.
